Acceptance of Terms

Welcome to Broken Fingers+. These Terms & Conditions (the "Terms") govern your access to and use of brokenfingers-plus.com (the "Site") and every purchase you make through it. The Site is owned and operated by Brokenness Ltd., a company registered in Hong Kong, trading under the brand Broken Fingers+ 破指自愈.

By browsing, creating an account, placing an order, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and any policies referenced within them. If you do not agree with any part of these Terms, please do not use the Site or place an order.

These Terms apply to everyone who visits the Site, whether you are simply browsing or completing a purchase. We have written them in plain language wherever possible, because we would rather you actually understand the agreement than wade through legalese. If anything here is unclear, you are always welcome to email us at info@brokenfingers-plus.com before you buy.

You should be able to form a legally binding contract under the laws that apply to you. If you are using the Site on behalf of a company, school, or organisation (for example, when arranging a corporate gift or workshop), you confirm that you are authorised to accept these Terms on that organisation's behalf.

Who We Are

Broken Fingers+ is a Hong Kong social enterprise. Behind every piece is a small team and a community of makers, and we think it matters that you know who you are buying from.

Our products are handmade by makers (工藝師) at local sheltered workshops. Each item is hand-stitched in small batches, which means we rarely hold large quantities in ready stock — most orders are made for you after you place them. This is central to our social mission: every purchase helps create meaningful, dignified work.

Our leather goods are crafted from a 69% apple-pomace bio-based leather (apple-pomace bio-based material), which is USDA Certified Biobased and verified to ASTM D6866-22 by Beta Analytic. It is a tough, hard-wearing material made to last. Where we describe the environmental qualities of our materials, those claims are based on these certifications and nothing beyond them.

Your Account

You can browse the Site and check out without registering, but you may choose to create an account to make future orders smoother and to keep track of your purchases. An account is optional — never a requirement for shopping with us.

If you do create an account, you agree to:

  • Provide accurate, current, and complete information, and keep it up to date — particularly your delivery address, email, and phone number, which we rely on to fulfil and deliver your order.
  • Keep your login details confidential and not share them with others.
  • Take responsibility for all activity that happens under your account. If you suspect any unauthorised use, please let us know promptly at info@brokenfingers-plus.com so we can help.

You may ask us to delete your account and the personal data linked to it at any time. We will action this in line with our Privacy Policy, though please note that, under Hong Kong tax law, we are required to retain certain order records for seven years even after an account is closed.

We may suspend or close an account if we reasonably believe it has been used for fraud, abuse, or any breach of these Terms. Where we do so, we will tell you why unless we are legally prevented from doing it.

Products & Orders

Because almost everything we sell is made to order by hand, the ordering process works a little differently from a mass-market shop. Here is what to expect.

Product information. Product images are for reference only. We photograph our goods as faithfully as we can, but screens vary and natural materials differ from piece to piece. Slight differences in colour, grain, and texture are an inherent feature of handmade leather goods — they are part of the character of the piece, not a defect.

How an order is formed. When you place an order, you are making an offer to buy. Your order is only confirmed and accepted once we have processed it and dispatched your item. Receiving an automated order-confirmation email acknowledges that we have received your order; it does not by itself mean we have accepted it.

When we may cancel. On rare occasions we may need to cancel an order — for example, if an item is unexpectedly out of stock, if a product has been mispriced, or if we cannot verify the order. If this happens, we will contact you and issue a full refund for that item. We reserve the right to change prices and to discontinue products at any time without prior notice.

Making and delivery times. Our makers hand-stitch every order, so please allow time:

  • Standard production: 3–5 working days for all orders.
  • International orders: add roughly 3 working days (to move the item from the workshop to our studio for inspection and packing), for about 6–8 working days of preparation overall.
  • Customised or personalised pieces (e.g. monogramming): 20–30 working days to make, plus shipping time.

Every order is hand-checked one by one, packed in an eco-friendly paper bag, and sent with a thank-you card. Full shipping rates, delivery windows, and our returns and warranty terms are set out on our dedicated Shipping, Returns & Exchanges, and Warranty pages, which form part of your agreement with us.

Pricing & Payment

All prices shown on the Site are in Hong Kong Dollars (HKD) unless clearly stated otherwise. Prices are displayed at checkout before you confirm payment, so you always see the total before you commit.

Payment. Payment is processed securely through our checkout provider (Shopify Payments and the payment methods it supports, such as major credit cards and Apple Pay). We do not store your full credit-card number — card data is handled by the encrypted payment processor, not by us. Your order is made and dispatched only after payment has been successfully received.

Pricing errors. We work hard to keep prices accurate, but errors can occasionally slip through. If we discover that an item has been listed at an incorrect price after you have ordered, we will contact you before dispatch and give you the choice of confirming the order at the correct price or cancelling it for a full refund. We are not obliged to fulfil an order at an obviously incorrect price.

Shipping, duties, and taxes. Local Hong Kong delivery and international shipping rates are calculated at checkout and explained on our Shipping page. For international orders, please note that your local customs authority may charge import duties or taxes on arrival. These are the responsibility of the recipient. We cannot estimate them in advance and are unable to pay them on your behalf.

Refunds. Where a refund is due — for example, on a cancelled order or an approved return — it is made back to your original payment method. Card and Apple Pay refunds typically take 5–10 working days to appear, depending on your bank; FPS or bank-transfer refunds usually take 1–3 working days. The Beauty of Handmade — Variation Disclaimer

This is the part we genuinely want you to read, because it shapes what to expect when your piece arrives.

Every Broken Fingers+ item is hand-stitched by a maker, one stitch at a time, in small batches. That human touch is the whole point — but it also means no two pieces are perfectly identical. You may notice:

  • Slight colour differences between your item and the on-screen photo, or between two items of the same style, since natural and bio-based materials take colour in their own way.
  • Variation in grain and texture across the surface of the material.
  • Minor differences in stitching that come from being sewn by hand rather than by machine.

These characteristics are features of a handmade leather good, not defects, and they are not grounds for a return on the basis of personal preference. They are precisely what makes your piece one of a kind.

This does not affect your rights where something is genuinely wrong. Manufacturing faults — such as loose or broken stitching, damaged hardware, or an obvious colour mismatch — are treated as defects and are covered under our Returns & Exchanges policy and, where applicable, our one-year warranty. Intellectual Property

All content on the Site — including text, photographs, illustrations, graphics, page design, layout, our logo, brand name, and fonts — is owned by Broken Fingers+ (Brokenness Ltd.) or its licensors, and is protected by intellectual-property laws.

You are welcome to view, browse, and share links to our pages, and to enjoy the content for your own personal, non-commercial use. You may not, however, without our prior written permission:

  • Copy, reproduce, republish, or redistribute any part of the Site or its content.
  • Use our images, copy, designs, logo, or brand name for any commercial purpose.
  • Modify, adapt, or create derivative works from our content, or remove any copyright or proprietary notices.

The Broken Fingers+ name and logo are our trade marks. Nothing on the Site grants you any right or licence to use them. If you would like to feature our work — for press, a collaboration, or a feature — we would love to hear from you; please reach out at info@brokenfingers-plus.com and we can usually find a way to say yes.

Acceptable Use

We want the Site to be a safe, welcoming place for everyone. By using it, you agree to use it lawfully and considerately, and in particular you agree to:

  • Provide accurate and truthful information when you order, register, or contact us.
  • Use the Site only for lawful purposes and not for any fraudulent or illegal activity.
  • Not attempt to hack, gain unauthorised access to, damage, overload, or otherwise disrupt the Site, its servers, or its underlying systems.
  • Not introduce viruses, malicious code, or any technology that could harm the Site or other users.
  • Not scrape, harvest, or systematically extract data or content from the Site without our written consent.
  • Not impersonate any person or misrepresent your affiliation with any person or organisation.

If you breach this section, we may restrict or withdraw your access to the Site, cancel any related orders, and, where appropriate, report the matter to the relevant authorities. We may also take any other action available to us under these Terms or the law.

Third-Party Links & Services

To run the Site and fulfil your orders, we rely on a number of trusted third-party services, and our pages may occasionally link to websites we do not control.

Services we use. These include, for example, our e-commerce and checkout platform (Shopify), our payment processor, our couriers and postal carriers for delivery, our email tools for newsletters you have opted into, and analytics services. Each of these providers operates under its own terms and privacy practices. We share only the information necessary for them to do their job — for instance, a courier receives your name, delivery address, and phone number. More detail on how we handle your data is in our Privacy Policy.

External links. Where the Site links to a third-party website — a partner, a press article, or a social-media page — that link is provided for convenience only. We do not control, endorse, or take responsibility for the content, products, or practices of any external site. Once you leave brokenfingers-plus.com, these Terms no longer apply, and we encourage you to read the terms and privacy policy of any site you visit.

While we choose our partners with care, we cannot guarantee the performance of services we do not operate, and we are not responsible for errors, delays, or failures caused by a third party — though we will always do our best to help you resolve any problem that touches your order.

Limitation of Liability

We stand firmly behind the quality of our products and the care we put into every order. At the same time, the law allows us to set sensible limits on our liability for the operation of the Site, and this section explains them.

To the fullest extent permitted by law, Broken Fingers+ (Brokenness Ltd.) is not liable for:

  • Losses arising from the Site being temporarily unavailable, interrupted, or containing errors.
  • Losses caused by the acts, omissions, errors, or delays of third-party services, including couriers, postal carriers, and payment processors.
  • Indirect, incidental, special, or consequential losses — for example, loss of profit, loss of opportunity, or loss of data — arising out of your use of the Site.

Where we are found liable despite the above, our total liability to you in connection with any order will not exceed the amount you actually paid for the product(s) giving rise to the claim.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law — including liability for death or personal injury caused by our negligence, or for fraud. Your statutory rights as a consumer are not affected by anything in this section.

Indemnity

If your misuse of the Site causes a problem for us, it is fair that you, rather than us, bear the cost. Accordingly, you agree to indemnify and hold harmless Broken Fingers+ (Brokenness Ltd.), its directors, employees, makers, and partners from and against any reasonable claims, losses, liabilities, and costs (including reasonable legal fees) arising out of:

  • Your breach of these Terms or any policy referenced in them.
  • Your misuse of the Site or its content.
  • Your violation of any law or of the rights of any third party in connection with your use of the Site.

This obligation is intended to cover genuine misuse — it is not meant to discourage you from raising a legitimate complaint or exercising your consumer rights. If you have a concern about an order, please contact us; we would always rather talk it through than reach for the fine print.

Governing Law & Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them, your use of the Site, or any order you place, are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (Hong Kong SAR).

We genuinely hope it never comes to a dispute — and in practice, almost everything can be sorted out with a friendly email. If something goes wrong, please contact us first at info@brokenfingers-plus.com. Most issues — a delivery delay, a fault, a question about a refund — are resolved quickly and informally once we understand what happened.

If a dispute cannot be resolved amicably, you agree that it will be subject to the exclusive jurisdiction of the courts of the Hong Kong SAR. This does not deprive you of any protection you have under mandatory consumer-protection laws that apply to you.

Changes to These Terms & Severability

Updates. We may update these Terms from time to time — for example, to reflect changes in our products, our processes, or the law. When we do, we will post the revised version on this page and update the "last updated" date shown at the top. Your continued use of the Site after a change takes effect means you accept the updated Terms, so we encourage you to check back from time to time. For significant changes that affect existing customers, we will aim to give reasonable notice.

Severability. If any provision of these Terms is found by a court to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

No waiver. If we do not enforce a particular right or provision on one occasion, that does not mean we waive it or give up the right to enforce it later.

Entire agreement. These Terms, together with our Privacy Policy, Shipping, Returns & Exchanges, and Warranty pages, make up the whole agreement between you and us regarding your use of the Site, and they supersede any earlier understanding on the same subject.

Why does my order take a little while? Because it is made for you. Each piece is hand-stitched in a small batch by our makers (standard production is 3–5 working days; customised pieces 20–30 working days), then hand-checked and packed before it ships.

Is the slight colour difference a fault? No — natural variation in colour, grain, and texture is a feature of handmade leather goods. Genuine manufacturing faults are a different matter and are covered by our Returns & Exchanges and Warranty policies.

Can I return a customised item? Personalised and customised pieces (monogramming, custom sizing, corporate gifts) cannot be returned for change of mind, since they are made specifically for you. Please see our Returns & Exchanges page for full details.

What do these materials mean for the planet? Our leather is a 69% apple-pomace bio-based material that is USDA Certified Biobased and verified to ASTM D6866-22. Those are the certifications behind our environmental claims.
